SmartDevOpsCore ("we," "our," "us") respects your privacy and is committed to protecting your personal data. This Privacy Policy describes how we collect, use, store, and share information when you visit our website, submit inquiries, or engage our services.

1.2 Information We Collect

1.3 Purpose of Processing

Your personal data is processed for the following purposes: responding to your inquiries and project proposals, delivering contracted DevOps services, sending service-related communications, maintaining internal records for tax and accounting compliance, and improving our website and service offerings.

1.4 Legal Basis (GDPR)

We process your data under Article 6(1)(b) of the General Data Protection Regulation (EU) 2016/679, as processing is necessary for the performance of a contract or to take steps at your request prior to entering into a contract. For marketing communications, we rely on your explicit consent under Article 6(1)(a).

1.5 Data Retention

Personal data is retained only for as long as necessary to fulfill the purposes for which it was collected. Inquiry data is retained for up to 24 months after the last communication. Contract-related data is retained for the duration of the engagement plus 5 years in accordance with Polish tax law.

1.6 Data Sharing

We do not sell, rent, or trade your personal information. Data may be shared with trusted third-party processors (e.g., cloud hosting providers, payment processors) solely for service delivery purposes, all bound by data processing agreements compliant with GDPR Article 28.

1.7 Your Rights

1.8 Data Security

We implement appropriate technical and organizational measures to protect your data, including TLS encryption in transit, AES-256 encryption at rest, access controls, and regular security audits. In the event of a data breach, we will notify the relevant supervisory authority within 72 hours as required by GDPR Article 33.

These Terms of Service ("Terms") govern your use of services provided by SmartDevOpsCore ("we," "our," "us"). By engaging our services, you agree to be bound by these Terms.

2.1 Scope of Services

SmartDevOpsCore provides DevOps engineering services including but not limited to CI/CD pipeline automation, container orchestration, infrastructure provisioning, observability platform setup, automated testing, security auditing, and ongoing production support retainers. Each engagement is governed by a mutually agreed Statement of Work (SOW).

2.2 Project Proposals & Pricing

All pricing listed on our website or in proposals are indicative and subject to final scoping. A binding price is established only upon written acceptance of a formal project proposal or SOW. Prices are quoted in USD unless otherwise specified and are exclusive of applicable taxes.

2.3 Payment Terms

Invoices are payable within 14 days of issuance unless otherwise agreed in the SOW. Late payments incur a 2% monthly late fee. Work may be paused if invoices remain unpaid for more than 30 days. All online payments are processed securely via Stripe.

2.4 Intellectual Property

Upon full payment of all agreed invoices, SmartDevOpsCore assigns all worldwide intellectual property rights in the client-specific deliverables — including source code, configuration files, infrastructure templates, and documentation — directly to the Client. Pre-existing tools, frameworks, and libraries used in delivery remain the property of their respective owners.

2.5 Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This obligation survives termination of the agreement for a period of 3 years.

2.6 Limitation of Liability

SmartDevOpsCore's total liability under any engagement shall not exceed the total fees paid by the Client for the specific service giving rise to the claim. We shall not be liable for indirect, incidental, or consequential damages, including lost profits or data loss resulting from third-party service failures.

2.7 Termination

Either party may terminate an engagement with 14 days' written notice. Upon termination, the Client shall pay for all work completed up to the termination date. All deliverables completed and paid for shall be transferred to the Client.

SmartDevOpsCore is committed to fair and transparent commercial practices. This Refund Policy outlines the conditions under which refunds may be issued for our services.

4.1 Project-Based Services

For project-based engagements governed by a signed SOW, refunds are handled as follows:

• Pre-Project Cancellation: If you cancel before any work has commenced, you are entitled to a full refund of any advance payment within 14 business days.
• Mid-Project Cancellation: If you cancel after work has begun, you will be invoiced for all work completed up to the cancellation date. Any excess payment above the invoiced amount will be refunded within 14 business days.
• Delivered Work: Payments for completed and delivered milestones are non-refundable, provided the deliverables meet the specifications agreed in the SOW.

4.2 Retainer Services

Monthly retainer fees are billed at the beginning of each month. If you wish to cancel your retainer, provide 30 days' written notice. You will receive a prorated refund for the unused portion of the current billing period.

4.3 Dissatisfaction with Deliverables

If you believe delivered work does not meet the agreed specifications in the SOW, notify us in writing within 14 days of delivery. We will review the claim and, if justified, either remedy the deliverables at no additional cost or issue a partial refund proportional to the scope of non-conformance.

4.4 Refund Process

To request a refund, contact us at [email protected] with your project reference number and a description of the issue. Refunds are processed to the original payment method within 14 business days of approval.

4.5 Exceptions

Refunds are not available for: (a) work completed and accepted by the Client; (b) third-party costs incurred on behalf of the Client (e.g., cloud infrastructure, software licenses); (c) consultations and discovery sessions already delivered; (d) breach of these Terms by the Client.
